Terms of Use for Linda’s Crafter Club Annual Subscription Plan

Effective Date: April 1, 2025

 

1. Introduction

1.    Welcome to Linda’s Crafter Club! The following Terms of Use (“Terms”) are entered into by and between you and the company you represent (“you” and “your”) and Red River Quiltworks LLC dba Linda’s Electric Quilters (“us”, “our”, “we” and “Linda’s”). Hereinafter, by agreeing to the Terms, you are a “Linda’s Crafter Club Member” pursuant to the Terms hereof.

2.    By subscribing to our annual membership plan ("Membership"), you agree to the Terms. Please read them carefully before subscribing.

 

2. Membership Benefits

As a Linda’s Crafter Club Member, you are entitled to the following benefits:

1.    Free Standard Economy Shipping on all orders within the lower 48 states of the United States. Shipping to HI, AK, PR, Guam, U.S. territories, FPO, APO, and international locations are not included.

2.    Order Prioritization for products in stock at Linda’s main warehouse. Orders containing items from partner warehouses may have varied processing and shipping times.

3.    5% Discount on all orders, applied in addition to active sales or promotional offers. Some exclusions apply. If another discount code is added to your order you will receive the greater of the two discounts.

4.    Monthly Gift Drawing Entry: Each active Member is automatically entered into a monthly drawing for free gifts. (See Section 4 for details.)

 

3. Membership Terms

1.    The Membership is valid for one (1) year from the date of purchase, and will automatically renew. You will receive an email notification reminder prior to the annual renewal. 

2.    By agreeing to these Terms and subscribing to the Membership, you agree to pay the Membership fees charged to you as specified in your order (“Membership Fee”).

3.    Membership Fees are non-refundable and non-transferable.

4.    Membership benefits apply only to purchases made by the account holder.

5.    Linda’s reserves the right to modify or terminate Membership benefits at any time in our sole discretion, with notice provided to Members via email or website updates. Your continued use of the Membership following posting of revised Membership benefits under these Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes as they are binding on you.

6.    The Membership benefits start when you agree to the Terms and ends when this agreement has been terminated, or your Membership has been cancelled.

 

4. Monthly Gift Drawing Terms

1.    No purchase necessary to enter or win.

2.    Each active Member is automatically entered into the monthly drawing.

3.    Winners will be selected randomly from the pool of active Members.

4.    Odds of winning depend on the number of eligible Members at the time of the drawing.

5.    Winners will be notified via email and must respond to claim their prize.

6.    Prizes are non-transferable and may not be redeemed for cash or credit.

7.    Linda’s reserves the right to substitute a prize of equal or greater value if the advertised prize is unavailable.

8.    By accepting a prize, winners grant Linda’s permission to use their name and likeness for promotional purposes, except where prohibited by law.

9.    This drawing is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

 

5. Limitations and Exclusions

1.    Linda’s is not responsible for shipping delays caused by carriers, weather conditions, or other factors beyond our control.

2.    Discounts and free shipping benefits do not apply to gift cards or subscription renewals. Other discounts or offers on the site may override the 5% membership discount as discounts are not stackable. 

3.    Any abuse of Membership benefits, including but not limited to excessive returns or fraudulent activities, may result in termination of Membership without refund.

4.    TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE LIABILITY OF LINDA’S, ITS AFFILIATES AND THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND MANAGERS, TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED AN AMOUNT EQUAL TO THE MEMBERSHIP FEES PAID BY YOU. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

 

6. Modifications, Cancellation and Termination

1.    Linda’s reserves the right to modify these Terms at any time. Updated Terms will be posted on our website, and continued use of the Membership constitutes acceptance of any changes.

2.    You may cancel your Membership at any time by managing your subscription on our website in Manage Subscription or by contacting us to cancel.  Cancellation will prevent future charges but does not result in a refund for the current billing period. You will retain access to your Membership benefits until the end of the current subscription period. To avoid renewal charges, you must cancel prior to the next filling cycle.

3.    Memberships are non-refundable except as required by law. We do not offer partial or prorated refunds for unused time in a billing cycle.

4.    Linda’s may terminate a Membership at its discretion for any violations of these Terms or other policies.

 

7. Governing Law

1.    All matters relating to these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Texas without giving effect to any choice or conflict of law provision or rule (whether of the State of Texas or any other jurisdiction).

2.     Any legal suit, action, or proceeding arising out of, or related to, these Terms shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
